Who we are
THIS MOMENT AI LIMITED (“thismoment”, “we”, “us”) is the controller of the personal data described in this policy. We are registered in England and Wales under company number 17470658. Our registered address is 55 Elm Drive, Hove, BN3 7JA, United Kingdom.
For any privacy question or request, email al@thismoment.ai. We aim to respond within 30 days.
What this policy covers
This policy applies to personal data we process when you:
- visit thismoment.ai or contact us through it;
- use any of our web applications, software-as-a-service products, or mobile apps for iOS, iPadOS and Android (together, our “apps”);
- work with us as a consulting client, supplier or partner.
An individual app may publish a short supplementary notice where it processes data in a way not described here. Where that happens, the supplementary notice and this policy apply together.
When we deliver consulting services and handle personal data on a client’s behalf, we act as that client’s processor under a written agreement, and the client’s own privacy notice applies to that data.
Data we collect
Data you give us
- Contact details such as your name, email address and company when you fill in a form, email us or create an account.
- Account data such as login credentials, profile settings and preferences. If you sign in with Apple or Google, we receive only the details you choose to share, which may be a private relay email address.
- Content you create, upload or enter into our apps, including prompts and files you submit to AI features.
- Communications with us, including support requests and feedback.
Data collected automatically
- Device and log data such as IP address, device model, operating system version, app version, browser type and timestamps.
- Usage data such as the features you use and how you navigate an app, collected in aggregated or pseudonymised form where possible.
- Diagnostics such as crash reports and performance data, used to keep our apps stable.
Data from third parties
- App stores and payment providers. Purchases and subscriptions in our mobile apps are processed by Apple or Google. We receive confirmation of the purchase, the product and its status. We never receive your full card details.
- Sign-in providers, if you choose to sign in with a third-party account.
We don’t knowingly collect special category data (such as health or biometric data) unless an app clearly asks for it for a feature you choose to use, in which case we ask for your explicit consent first.
How we use data and our legal bases
We use personal data only where we have a lawful basis under UK and EU data protection law:
- To provide our apps and services, including creating and managing your account, delivering features you request and processing purchases. Legal basis: performance of a contract.
- To respond to you when you contact us or ask for support. Legal basis: legitimate interests, or contract where you are a customer.
- To keep our services secure and reliable, including fraud prevention, debugging and abuse detection. Legal basis: legitimate interests.
- To improve our products using aggregated or pseudonymised usage and diagnostic data. Legal basis: legitimate interests, or consent where required.
- To send product updates or marketing where you have opted in. You can unsubscribe at any time. Legal basis: consent.
- To meet legal obligations, such as tax and accounting records. Legal basis: legal obligation.
We don’t use personal data for automated decisions that have legal or similarly significant effects on you.
AI features
Some of our apps use AI models to generate or analyse content. When you use these features, the content you submit is sent to the model provider to produce a response.
- We use providers under commercial terms that prohibit them from using your content to train their models.
- We don’t use your private content to train our own models without your explicit permission.
- AI output can be inaccurate. Features that use AI are identified in the app, and you should review output before relying on it.
Who we share data with
We don’t sell personal data, and we don’t share it for cross-context behavioural advertising. We share it only with:
- Service providers who process data on our behalf under contract, including cloud hosting and databases, email delivery, analytics and crash reporting, customer support tools and AI model providers.
- App stores and payment processors, such as Apple and Google, to handle purchases and subscriptions.
- Professional advisers such as lawyers and accountants, under a duty of confidentiality.
- Authorities where we are legally required to, or to protect the rights, property or safety of our users or others.
- A buyer or successor if we are involved in a merger, acquisition or sale of assets, subject to this policy.
We do not use third-party advertising SDKs in our apps, and we do not track you across other companies’ apps and websites. If that ever changes, we will ask for your permission first through Apple’s App Tracking Transparency prompt or its equivalent.
International transfers
Some of our service providers are based outside the UK and European Economic Area. When data is transferred internationally, we rely on adequacy regulations, the UK International Data Transfer Agreement or Addendum, or the EU Standard Contractual Clauses, together with additional safeguards where needed.
How long we keep data
We keep personal data only for as long as we need it:
- Account data: for as long as your account is open, then deleted within 30 days of closure.
- Contact form and support messages: up to 24 months after our last exchange.
- Logs and diagnostics: generally up to 90 days.
- Transaction and tax records: as long as the law requires, typically six years.
Backups are overwritten on a rolling basis and are not restored except to recover from an incident.
Security
We protect data with encryption in transit and at rest, access controls based on least privilege, and regular review of our providers. No system is perfectly secure, so if you believe your account has been compromised, contact al@thismoment.ai straight away. We will notify you and the relevant regulator of a personal data breach where the law requires it.
Your rights
Depending on where you live, you have the right to:
- access the personal data we hold about you and get a copy of it;
- correct data that is inaccurate or incomplete;
- have your data deleted;
- restrict or object to how we process it, including for direct marketing;
- receive your data in a portable format;
- withdraw consent at any time, without affecting processing that has already taken place.
To exercise any of these rights, email al@thismoment.ai. We may need to verify your identity first. We won’t charge a fee or treat you differently for exercising your rights.
California and other US states. Residents of states with consumer privacy laws have the right to know, access, correct and delete personal information, and to opt out of its sale or sharing. We don’t sell or share personal information as those laws define it.
If you are unhappy with how we have handled your data, you can complain to the UK Information Commissioner’s Office at ico.org.uk or your local data protection authority. We’d appreciate the chance to resolve your concern first.
Deleting your account
You can delete your account from the settings screen of any of our apps that lets you create one. Deleting your account removes your profile and content from our active systems within 30 days. If you can’t access the app, email al@thismoment.ai from the address on your account. Deleting an app from your device does not delete your account, and cancelling a subscription is handled separately through the App Store or Google Play, as explained on our support page.
Children
Our apps and services are not directed at children under 13, or under 16 in the EEA and UK where local law requires. We don’t knowingly collect personal data from children. If you believe a child has given us personal data, contact al@thismoment.ai and we will delete it.
Cookies and similar technologies
This website uses only the cookies and local storage needed to run it securely. We don’t use advertising cookies. If we add analytics that require consent, we will ask for it before setting them.
Our apps may store data on your device, for example to keep you signed in or remember your settings. You can clear this by signing out or deleting the app.
Changes to this policy
We may update this policy as our products and the law change. The date at the top shows when it was last revised. If we make a material change, we will tell you in the app or by email before it takes effect.
